D. Event Photography, Video, and Audio

Buhe Fest is a public, family-oriented cultural festival. Photographs, video recordings, livestreams, interviews, and audio recordings may be taken in public event areas by Buhe Fest, event venues, sponsors, vendors, media organizations, photographers, videographers, attendees, or other third parties.

Buhe Fest may use event images and recordings for lawful purposes such as documenting the festival, reporting on community activities, promoting future events, creating photo books, maintaining historical archives, fundraising, sponsorship reporting, and publishing content through websites, social media, advertisements, newsletters, press materials, and other media.

Additional notices, signs, waivers, or media releases may apply at particular events. Where reasonably practicable, attendees with a specific concern may contact event staff. However, because events take place in public or group settings, we cannot guarantee that an attendee will not appear incidentally in a photograph or recording created by us or by an independent third party.

4. Cookies and Similar Technologies

Our website and service providers may use cookies and similar technologies to:

  • Keep the website functioning;

  • Remember preferences and account settings;

  • Maintain shopping carts and login sessions;

  • Support registration, ticketing, payment, and security features;

  • Understand how visitors use the website;

  • Diagnose technical issues;

  • Measure website and campaign performance;

  • Display embedded content, maps, videos, or social-media features; and

  • Support advertising or promotional activities, where used.

Cookies may be classified as essential, functional, analytics, or advertising cookies.

You may be able to manage nonessential cookies through a cookie banner or preference tool made available on the website. You may also adjust your browser settings to reject or delete cookies. Blocking certain cookies may cause portions of the website, including checkout, account, mapping, or registration features, to operate incorrectly.

Some browsers offer “Do Not Track” or similar signals. Because there is not yet a universally accepted standard for responding to every such signal, our website may not respond to all browser-based signals. Where applicable law requires recognition of a valid opt-out preference signal, we will use reasonable efforts to honor it.

5. How We Disclose Information

We may disclose information to the following categories of recipients for legitimate operational and legal purposes.

A. Website and Technology Providers

We may disclose information to vendors that provide website hosting, cloud storage, cybersecurity, analytics, communications, account management, database, mapping, email, and technical-support services.

Our website is currently powered and secured by Wix. Wix may process information as a service provider to Buhe Fest and, in certain circumstances, for its own purposes under its privacy policy.

B. Payment, Ticketing, and Commerce Providers

Information may be disclosed to payment processors, banks, card networks, fraud-prevention providers, ticketing systems, shipping providers, fulfillment companies, and commerce platforms to process and fulfill transactions.

C. Event Venues and Operational Partners

We may disclose information to venues, farms, event organizers, security providers, check-in personnel, emergency personnel, parking operators, contractors, photographers, videographers, caterers, and other providers when reasonably necessary to operate an event, provide requested services, address safety concerns, or fulfill contractual obligations.

D. Vendors, Sponsors, Nonprofits, and Community Partners

Where appropriate, we may share limited information with participating vendors, sponsors, nonprofit organizations, and community partners to coordinate requested activities, benefits, introductions, promotions, or event participation.

We do not authorize independent vendors, sponsors, or exhibitors to use attendee information for unrelated marketing unless you have consented or the disclosure is otherwise permitted by law. These organizations may separately collect information from you at their booths, websites, promotions, or activities. Their collection is governed by their own privacy practices, not this Privacy Policy.

E. Professional Advisers

We may disclose information to attorneys, accountants, auditors, insurers, consultants, financial advisers, and other professional advisers where reasonably necessary.

F. Legal and Safety Disclosures

We may disclose information when we believe in good faith that doing so is necessary or appropriate to:

  • Comply with a law, regulation, subpoena, court order, or lawful governmental request;

  • Protect the health or safety of any person;

  • Investigate fraud, misconduct, threats, or security incidents;

  • Protect or enforce our rights, property, contracts, policies, or legal interests;

  • Assist law enforcement or emergency personnel; or

  • Prevent or limit potential harm or liability.

G. Business Transactions

Information may be disclosed or transferred as part of an actual or proposed merger, acquisition, financing, restructuring, sale of assets, transfer of operations, insolvency proceeding, or similar transaction. Any successor may continue to process information in accordance with this Privacy Policy, unless another notice is provided.

H. At Your Direction

We may disclose information when you ask us to do so, authorize the disclosure, intentionally interact with a third party, or use a feature that reasonably requires disclosure.

I. Aggregated and De-Identified Information

We may use and disclose information that has been aggregated, anonymized, or de-identified so that it cannot reasonably be linked to you. We may retain and use such information for any lawful purpose and will not attempt to re-identify it except as permitted by law.

6. Sale, Sharing, and Targeted Advertising

Buhe Fest does not sell personal information to third parties in exchange for money.

Certain privacy laws define “sale,” “sharing,” or “targeted advertising” broadly enough to include some uses of analytics, social-media, or advertising technologies that disclose online identifiers to third parties.

To the extent our activities are treated as a sale, sharing, or use for targeted advertising under applicable law, eligible residents may have the right to opt out. Requests may be submitted using the contact information in Section 16 or through any privacy-preference tool made available on our website.

We do not knowingly sell or share for targeted advertising the personal information of children under 16.

7. Marketing Communications

You may unsubscribe from promotional emails by selecting the unsubscribe link included in the message or by contacting us.

Even after you opt out of marketing, we may continue to send nonpromotional communications, including transaction receipts, ticket confirmations, event changes, safety information, account notices, and responses to your requests.

Your mobile carrier’s message and data rates may apply to text messages. Where required, we will obtain consent before sending promotional text messages. Consent to receive marketing messages is not a condition of purchase.

8. Children’s Privacy

Buhe Fest welcomes families and children at its in-person events. However, our website, online store, membership features, vendor opportunities, and online registration services are intended for use by adults and are not directed to children under 13.

We do not knowingly request or collect personal information online directly from a child under 13 without verifiable consent from a parent or legal guardian.

Parents and guardians may register or purchase tickets for children and may provide limited information necessary for attendance, safety, accommodations, or participation. The adult providing such information represents that they are authorized to do so.

If we learn that a child under 13 has submitted personal information online without appropriate parental consent, we may delete or restrict that information as reasonably required by law. A parent or guardian who believes a child has provided information to us may contact us using the information in Section 16.

Parents and guardians remain responsible for supervising children’s interactions with independent vendors, sponsors, websites, social-media services, and event participants.

9. Sensitive Information

Certain information you voluntarily provide—such as allergy information, dietary restrictions, accessibility needs, medical considerations, or emergency details—may be considered sensitive under some laws.

Please provide only the minimum information necessary for us to address your request. We use this information primarily to evaluate and provide requested accommodations, support event safety, or comply with legal obligations. We may disclose it to staff, venues, emergency personnel, or service providers when reasonably necessary for those purposes.

Buhe Fest cannot guarantee that every accommodation or dietary request can be fulfilled. Providing such information does not create a medical, fiduciary, custodial, or special relationship between you and Buhe Fest.

10. Third-Party Websites, Vendors, and Services

Our website may contain links to or integrations with Google Maps, social-media platforms, payment services, vendors, sponsors, nonprofit organizations, and other third-party websites or services.

When you interact with a third party, that party may independently collect information from you. Buhe Fest does not control and is not responsible for the privacy, security, content, availability, or practices of independent third parties.

A link, integration, sponsorship, vendor relationship, or appearance at a Buhe Fest event does not mean that Buhe Fest endorses or guarantees the third party’s privacy or security practices. Please review the third party’s policies before providing information.

11. Data Retention

We retain personal information for as long as reasonably necessary to:

  • Provide services and complete transactions;

  • Maintain membership, loyalty, attendance, sponsorship, vendor, and purchase records;

  • Fulfill the purposes described in this Privacy Policy;

  • Comply with tax, accounting, insurance, safety, contractual, and legal obligations;

  • Resolve disputes and enforce agreements;

  • Maintain appropriate historical and archival records; and

  • Protect against fraud, misuse, and legal claims.

Retention periods vary according to the nature of the information, the relationship involved, legal requirements, and operational needs.

When information is no longer reasonably needed, we may delete, anonymize, aggregate, or securely dispose of it. Backup, archival, fraud-prevention, legal-hold, and system records may remain for an additional period.

12. Information Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

However, no website, transmission method, payment system, storage platform, or security measure is completely secure. We cannot and do not guarantee absolute security.

You are responsible for maintaining the confidentiality of your account credentials and for notifying us promptly if you believe your account or information has been compromised.

To the maximum extent permitted by law, transmission of information to or through the website is at your own risk.

13. Your Privacy Choices and Rights

Depending on your place of residence and subject to applicable exceptions, you may have the right to request that we:

  • Confirm whether we process your personal information;

  • Provide access to or a copy of certain personal information;

  • Correct inaccurate personal information;

  • Delete certain personal information;

  • Provide certain information in a portable format;

  • Restrict or object to certain processing;

  • Opt you out of targeted advertising, sale, or sharing;

  • Limit certain uses of sensitive personal information;

  • Withdraw consent where processing is based on consent; or

  • Explain or appeal a decision concerning a privacy request.

These rights are not absolute. We may deny or limit a request when permitted by law, including where information is needed to complete a transaction, maintain security, protect legal rights, comply with recordkeeping requirements, preserve evidence, or exercise free-speech or other legal rights.

To submit a request, contact us using the information in Section 16 and include:

  1. Your full name;

  2. The email address or telephone number associated with your interaction;

  3. The nature of your request;

  4. Your state or country of residence; and

  5. Enough information for us to locate the relevant records.

We may request additional information to reasonably verify your identity and authority. We will use verification information only for that purpose.

Where permitted by law, an authorized agent may submit a request for you. We may require proof of authorization and may contact you directly to verify the request.

We will not unlawfully discriminate against you for exercising an applicable privacy right. However, some information is necessary to provide requested products, tickets, loyalty benefits, or services, and deleting that information may affect our ability to continue providing them.

14. International Visitors

Buhe Fest is based in the United States, and our website and events are primarily directed to individuals in the United States.

If you access the website from another country, your information may be transferred to, stored in, and processed in the United States or another jurisdiction where our service providers operate. Privacy laws in those jurisdictions may differ from the laws of your country.

By providing information where legally permitted, you understand that it may be processed in these jurisdictions, subject to applicable safeguards and legal requirements.

15. Changes to This Privacy Policy

We may revise this Privacy Policy from time to time to reflect changes in our website, events, technology, business practices, or legal obligations.

The updated version will be posted on this page with a revised “Last Updated” date. Changes become effective when posted unless a later date is stated.

Where required by law, we may provide additional notice or request consent. Your continued use of the website after an updated policy becomes effective signifies your acknowledgment of the revised policy, to the extent permitted by law.

17. Additional Notice for California Residents

This section applies only where the California Consumer Privacy Act, as amended by the California Privacy Rights Act, applies to Buhe Fest and the particular information involved.

During the preceding 12 months, we may have collected the categories of information described in Section 2, including identifiers, customer-record information, commercial information, internet or electronic-network activity, approximate geolocation information, audio or visual information, professional or organizational information, inferences, and sensitive information voluntarily provided for accommodations or event needs.

We collect and use these categories for the business and commercial purposes described in Section 3 and may disclose them to the categories of recipients described in Section 5.

We do not sell personal information for monetary consideration. We do not use or disclose sensitive personal information for purposes that require a separate right to limit under California law, except where otherwise disclosed at collection.

18. Interpretation and Scope

This Privacy Policy is intended to provide notice of our privacy practices and should be interpreted consistently with applicable law.

Nothing in this Privacy Policy is intended to create contractual rights beyond those required by law, waive any legal defense, admit that any particular privacy law applies to Buhe Fest, or limit any lawful right, remedy, exception, exemption, privilege, or protection available to Buhe Fest.

If any provision of this Privacy Policy is found unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

Before publication, Buhe Fest should confirm which payment processor, email-marketing service, analytics tools, advertising pixels, and cookie-consent settings are actually enabled. A Maryland-licensed attorney should also review the final version alongside the site’s Terms and Conditions, media release, vendor agreements, and event waivers.
